PairFit Terms & Conditions

Welcome to PairFit (the “App” or “Service”). By downloading, installing, or using PairFit, you agree to these Terms & Conditions (the “Terms”) which constitute a legally binding agreement between you and PairFit (“we,” “us,” “our”). If you do not agree to any part of these Terms, you may not use the App or its Services.
1. Acceptance of Terms
1.1 Binding Agreement
By accessing or using PairFit, you affirm that you are of legal age and capacity to form a binding contract, or, if you are under the age of majority, that you have the necessary permissions from a parent or guardian to use the App. If you do not meet these requirements, you must not access or use the App.
1.2 Updates to Terms
We reserve the right to modify or update these Terms at any time, at our sole discretion. If we make material changes, we will notify you via the App or by other reasonable means. Your continued use of PairFit after any such changes indicates your acceptance of the new Terms.
2. Description of the Services
2.1 Overview
PairFit is a mobile application designed to connect users for workout or fitness-related activities. Depending on your geographic region, the Service may allow you to:
- Create a personal profile.
- Find and pair with other users with similar fitness goals.
- Share details about your workouts or routes.
- Chat or communicate with other users.
- Access fitness-related information, workout ideas, or route suggestions.
2.2 No Medical Advice
All information provided by PairFit, including but not limited to suggested workouts or routes, is intended for informational purposes only. The App does not provide medical advice or professional diagnosis or treatment. You should always consult a qualified healthcare professional before starting any exercise program, especially if you have a pre-existing medical condition.
3. User Accounts
3.1 Registration
To access certain features of PairFit, you may be required to create an account. You agree to:
- Provide accurate and complete information.
- Update your account information promptly if it changes.
- Keep your login credentials confidential, and not share them with any third party.
3.2 Account Responsibility
You are fully responsible for all activities that occur under your account. If you suspect unauthorized use of your account, you must notify us immediately.
3.3 Account Suspension or Termination
We reserve the right, at our sole discretion, to suspend or terminate your account if we believe you have violated these Terms or engaged in any unauthorized, abusive, or illegal behavior.
4. User Conduct
4.1 Acceptable Use
You agree to use PairFit and its Services only for lawful purposes. You will not:
- Harass, intimidate, or otherwise harm other users.
- Post or transmit any user content (including text, images, or other media) that is unlawful, defamatory, obscene, or infringing on intellectual property rights.
- Circumvent or attempt to circumvent any security measures of PairFit.
- Scrape, mine, or extract data from the App without our prior written consent.
4.2 User Content
You are solely responsible for any content you upload, post, or transmit via the App. By submitting content, you grant PairFit a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display such content for the purposes of operating and improving our Services.
You represent and warrant that you have the necessary rights to grant this license.
5. Intellectual Property
5.1 PairFit Ownership
All content, features, and functionalities offered by PairFit—such as text, graphics, logos, button icons, images, and software—are owned by or licensed to us. They are protected by intellectual property laws, including copyright and trademark laws. You may not reproduce, distribute, modify, create derivative works from, or otherwise exploit any part of our App except as expressly authorized by these Terms or with our prior written permission.
5.2 Feedback
If you submit ideas, suggestions, or feedback regarding PairFit, you agree that such submissions are non-confidential and become the sole property of PairFit. We may use them without restriction or compensation to you.
6. Safety and Assumption of Risk
6.1 Safety Precautions
PairFit promotes physical activities which can carry inherent risks. You acknowledge and agree that:
- You assume all risks associated with engaging in exercise or physical activity recommended by the App or arranged with another user.
- You are solely responsible for deciding whether you are fit and able to participate in any suggested workouts or routes.
6.2 No Liability for Third-Party Interactions
PairFit is only a platform to connect users. We do not conduct background checks on users or guarantee their behavior, fitness level, or capabilities. Any dispute or issue arising from interactions with other users is solely between you and such users. We are not responsible for any injuries, losses, or damages resulting from user interactions.
7. Third-Party Services and Links
Our App may contain links to or integrations with third-party websites, apps, or services (“Third-Party Services”). We do not control, endorse, or assume responsibility for such Third-Party Services. Your use of Third-Party Services is subject to their respective terms and conditions.
8. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, PAIRFIT AND ITS AFFILIATES DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ALL CONTENT AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PAIRFIT, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF PAIRFIT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10. Indemnification
You agree to defend, indemnify, and hold harmless PairFit, its affiliates, and their respective officers, directors, employees, and agents from and against all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your violation of these Terms; (b) your use of or access to the App; (c) your violation of any third-party rights, including privacy or intellectual property rights; or (d) any content you submit through the App.
11. Termination
We may, at our sole discretion, suspend or terminate your access to the App at any time, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, all licenses and rights granted to you in these Terms will immediately cease. The provisions of these Terms relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution will survive any termination
12. Miscellaneous
13.1 Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision will be modified to the minimum extent necessary so that it becomes valid and enforceable. All other provisions will remain in full force and effect.
13.2 Entire Agreement
These Terms, together with our [Privacy Policy] and any other legal notices published by PairFit, constitute the entire agreement between you and PairFit regarding your use of the App.
13.3 No Waiver
No failure or delay by PairFit in exercising any right under these Terms shall constitute a waiver of that right.
13.4 Assignment
You may not assign or transfer these Terms or any rights or obligations herein without our prior written consent. We may assign or transfer these Terms at our discretion without restriction.
